Agreement
These Terms of Use are a contract between you and Petrichor Enchantment Inc., an Ontario corporation trading as LumiVeil ("we", "us", "Brix"). They govern your use of the Brix VPN applications, servers and website.
By creating an account, downloading the app, or using the service, you accept these terms. If you do not accept them, do not use Brix VPN.
To use Brix VPN you must be at least 13 years old, or 16 if you are in the European Economic Area or the United Kingdom. If you are using Brix VPN for an organisation, you confirm you are authorised to bind it to these terms.
Our Privacy Policy forms part of this agreement.
Your account
You need an account to use Brix VPN. Your account is created automatically on your device and is tied to that device. There is no email address and no password. If you reset or replace your device, a free account does not carry over; a paid subscription can be restored through Apple or Google.
You are responsible for keeping your device secure and for activity under your account. Tell us promptly if you believe your account has been compromised.
One person, one account. Do not share your account, resell access, or operate multiple free accounts to avoid the data allowance.
You may close your account at any time from within the app on the device concerned. Closing an account does not by itself cancel a subscription bought through an app store — see Subscriptions below.
The service
Brix VPN encrypts your internet traffic and routes it through our servers. We offer two tiers:
Free. 10 GB of data each month, reset at the start of your monthly cycle. Access to a limited set of server locations, on one device at a time.
Paid. No data allowance, full server network, higher speeds, and the complete protocol set.
We provide the service on a best-efforts basis. We do not guarantee uptime, a particular connection speed, availability of any specific server or location, or that the service will work on any given network.
We may add, change or withdraw features, servers and locations. A censorship-resistant network changes constantly in response to blocking, so the available locations and protocols will vary over time. If we withdraw something material to a paid subscription, you may cancel and seek a pro-rata refund as described below.
Subscriptions, billing and refunds
Prices in Canadian dollars, inclusive of applicable taxes where we are required to collect them:

Auto-renewal. Subscriptions renew automatically at the end of each term at the same price, charged to your app store account within 24 hours of the term ending. We will not raise your renewal price without telling you at least 30 days beforehand; if we do raise it, you may cancel before it takes effect.
Cancellation. Cancel at any time in your Apple ID or Google Play subscription settings, at least 24 hours before the term ends. We cannot cancel a store subscription on your behalf. After cancelling you keep paid access until the end of the term already paid for.
Refunds. Purchases are made through Apple or Google, so refunds are handled under their policies, not ours. Apple refunds are requested at reportaproblem.apple.com; Google refunds through Google Play. Where consumer law in your country gives you a statutory withdrawal or cooling-off right, that right applies and nothing here limits it.
Free trials and promotions, where offered, convert to a paid subscription unless cancelled at least 24 hours before the trial ends. Terms specific to a promotion are stated when it is offered.
Acceptable use
Brix VPN exists to protect privacy and restore access to the open internet. It is not a shield for harming other people. You must not use the service to:
- Access, produce or distribute material depicting the sexual abuse or exploitation of children
- Send spam, bulk unsolicited messages, or operate mailing infrastructure for them
- Launch attacks on networks or systems: denial of service, port scanning, intrusion attempts, credential stuffing, or brute-forcing
- Distribute malware, ransomware, or command-and-control traffic for a botnet
- Commit fraud, phishing, identity theft, or payment-card abuse
- Harass, stalk, threaten, or defame another person
- Attempt to deanonymise, attack or overload our infrastructure, or circumvent the free-tier allowance
- Resell, sublicense or redistribute access to the service
- Breach export-control or sanctions law that binds us as a Canadian company
We operate a no-logs network, so we generally detect abuse through complaints, abuse reports from upstream providers, and signals that need no activity logging. We investigate with the limited data we hold.
This list is not a statement that all other conduct is endorsed by us. It is the conduct we will act on.
Local law is your responsibility
VPNs are lawful in most countries. In some they are restricted, licensed, or prohibited, and in a few the penalties are serious. The law also changes, sometimes quickly.
You are responsible for knowing whether using Brix VPN is lawful where you are, and for the consequences if it is not. We cannot give you legal advice and nothing here is legal advice.
We make the service available globally. Making it available is not a representation that your use of it complies with your local law. Making it available in a country is also not a representation that we can keep it working there.
We do not require you to tell us where you are, and we do not geo-restrict the apps. That is a privacy decision, not a legal assurance.
If you are in a place where using this service could put you at risk, consider that risk carefully before you rely on it.
Suspension and termination
We may suspend or terminate your account if you breach these terms, if we are required to by law, or if your use threatens the security or stability of the network.
Where circumstances allow, we warn you first and give you a chance to put things right. For serious breaches — the first five items under Acceptable use — we act immediately.
If we terminate your paid subscription for a breach you committed, no refund is due for the remainder of the term. If we terminate for any other reason, or discontinue the service, we refund the unused portion pro rata.
You may stop using Brix VPN at any time. On termination your licence to use the apps ends; the sections on intellectual property, disclaimers, liability, indemnity and governing law survive.
Intellectual property
The Brix VPN and LumiVeil names, logos and brand assets belong to Petrichor Enchantment Inc. These terms give you no right to use them.
Subject to these terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Brix VPN applications on devices you own or control, for your own use.
Where we publish client source code under an open-source licence, that licence governs your rights in that code and prevails over this section for the code it covers. Our trade marks are not licensed with it.
You may not reverse-engineer, decompile or disassemble the applications except to the extent that applicable law expressly permits it despite this restriction.
You keep all rights in your own data and traffic. We claim nothing in it.
App stores
If you obtained Brix VPN from the Apple App Store or Google Play, the following applies in addition to these terms.
Apple. This agreement is between you and Petrichor Enchantment Inc. only, not Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, regulatory non-compliance, or consumer protection claims. Apple is not responsible for investigating or resolving third-party intellectual property claims relating to the app. You represent that you are not located in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and that you are not on a U.S. Government prohibited-party list. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Google. Your use is also subject to the Google Play Terms of Service. Google is not a party to this agreement and is not responsible for the app or for support, and refunds for Play purchases follow Google's policies.
Disclaimers
To the fullest extent the law allows, Brix VPN is provided as is and as available, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We specifically do not warrant that:
- The service will be uninterrupted, timely, secure or error-free
- It will defeat any particular filtering, blocking or inspection system, in any country, at any time
- It will make you anonymous or untraceable
- It will protect you against an adversary who can compromise your device, observe your behaviour by other means, or correlate your traffic at scale
- Any particular server, protocol, location or speed will remain available
A VPN protects traffic in transit. It does not protect you from malware, phishing, weak passwords, a compromised device, or information you disclose yourself. It is one layer among several, not a complete defence.
Some jurisdictions do not allow the exclusion of implied warranties. Where that is so, these exclusions apply only to the extent permitted, and your statutory rights as a consumer are unaffected.
Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost data, lost goodwill, or business interruption, arising from your use of or inability to use Brix VPN.
Our total liability for all claims in any 12-month period is limited to the greater of the amount you paid us in that period, or CAD $50.
These limits apply whatever the legal theory, and even if we were advised that such damages were possible.
They do not apply to liability that cannot lawfully be limited: death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that your local consumer law does not permit us to exclude. If you are a consumer in the EEA, the UK, Australia or Canada, you keep every statutory right those laws give you, and nothing here reduces them.
Indemnity
You agree to indemnify Petrichor Enchantment Inc. against claims, losses and reasonable legal costs arising from your breach of these terms, your violation of law, or your infringement of another person's rights through your use of the service.
This does not apply where the claim arises from our own breach, negligence or wrongdoing. If you are a consumer, this clause applies only to the extent your local law permits.
Changes
We may change these terms. The effective date at the top shows the current version.
For material changes — anything affecting price, your rights, or what the service provides — we give at least 30 days' notice in the app and on our website. Continuing to use Brix VPN after the notice period means you accept the new terms. If you do not accept them, cancel before they take effect and we will refund the unused portion of a paid term.
Minor changes, such as corrections and clarifications, take effect when published.
Governing law and disputes
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules.
The courts of Ontario have exclusive jurisdiction over disputes, and you submit to that jurisdiction.
If you are a consumer, this does not deprive you of the protection of mandatory consumer law in your country of residence, or of the right to bring proceedings in your local courts where that law gives you it.
Before starting formal proceedings, please write to us so we can try to resolve the matter directly. Most issues are settled this way.
We do not require binding arbitration and we do not ask you to waive class-action rights.
General
Severability. If any provision is held unenforceable, it is modified to the minimum extent needed to make it enforceable, or severed. The rest stands.
No waiver. If we do not enforce a provision, we have not waived it.
Assignment. You may not assign these terms. We may assign them to a successor in a merger, acquisition or sale of assets, on notice to you.
Entire agreement. These terms and the Privacy Policy are the whole agreement between us about Brix VPN, and replace any earlier version.
Force majeure. We are not liable for failures caused by events beyond our reasonable control, including state-ordered network shutdowns, upstream provider failure, and natural disaster.
